Terms of Use
- 1. This page (together with the documents referred to on it) tells you the terms of use on which you may make use of our website at http://www.fieldworkeducation.co.uk (our site), whether as a guest or a registered user. Please read these terms of use carefully each time before you start to use the site as it is your obligation to check if changes have been made to these terms. By using our site, you indicate that you accept these terms of use and that you agree to abide by them. If you do not agree to these terms of use, please refrain from using our site.
- 2. INFORMATION ABOUT US
- 2.1. Our site is owned and operated by Fieldwork Education Limited ("We"). We are registered in England and Wales under company number 3299897 and have our registered office and main trading address at 25 Buckingham Gate, London, SW1E 6LD, United Kingdom. Our VAT number is GB 689 9298 37.
- 3. ACCESSING OUR SITE
- 3.1. By accessing our site you confirm that you have been authorized to do so by a school, college or other institution with which we have agreed to allow access (an Institution). You also confirm that you are doing so within the authority granted to you by such Institution for such purposes.
- 3.2. Whilst we aim to have our website available at all times (except when required for maintenance or other administration), we reserve the right to withdraw or amend the service we provide on our site without notice (see below). We will not be liable if for any reason our site is unavailable at any time or for any period.
- 3.3. From time to time, we may restrict access to some parts of our site, or our entire site, to users who have registered with us.
- 3.4. If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these terms of use.
- 3.5. You may use our site only for lawful purposes. You may not use our site in any way that breaches any applicable local, national or international law or regulation; in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect; for the purpose of harming or attempting to harm minors or adults in any way; to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (commonly referred to as spam); to knowingly transmit any data, send or upload any material that is or may be defamatory, offensive, obscene or of threatening character, or which is discriminatory (whether on the basis of sex, sexuality, race, age, disability or otherwise); which may, in our opinion, cause a nuisance to us or our associated companies, our staff or any other person; which is illegal or infringes upon our or a third party's intellectual property rights.
- 3.6. You also agree not to reproduce, duplicate, copy or re-sell any part of our site in contravention of the provisions of these terms; not to access without authority, interfere with, damage or disrupt any part of our site, any equipment or network on which our site is stored, any software used in the provision of our site, any equipment or network or software owned or used by any third party.
- 3.7. You are responsible for making all arrangements necessary for you to have access to our site. You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms, and that they comply with them.
- 3.8. You must not use nor allow others to use our site to gain unauthorized access to facilities or services nor for any activity with any of the following objectives or consequences:
- 3.8.1. corruption or destruction of our or a third party's data
- 3.8.2. violation of the privacy or rights under the Data Protection Act 1998 (or any other analogous legislation) of another person
- 3.8.3. continued use of an item of hardware after we have requested that the use cease
- 3.8.4. any other deliberate misuse of our site.
- 3.9. You must not (and you must not allow others to) attempt to gain unauthorized access to our site or to restricted sections of such website or to other accounts, computer systems or networks connected to our site, through hacking, password mining or any other means, nor to attempt to obtain materials or information not intentionally made available through our site.
- 4. INTELLECTUAL PROPERTY RIGHTS
- 4.1. We are the owner or the licensee of all intellectual property rights (as defined below) in our site, and in the material published on it or accessible through it (including without limitation all photographs, illustrations, images, text, audio clips, video clips and software). Those works are protected by copyright and other relevant laws and treaties around the world. All such rights are reserved.
- 4.2. You may not reproduce (in whole or in part), modify, transfer, republish, distribute, transmit (by electronic means or otherwise), create derivative works from, sell, or otherwise exploit the content of or materials on the our site without prior written consent from us. In particular, you may notinclude or allow third parties toinclude in any other publication, website or product the content of our site or the materials posted thereon. The content of and materials posted on our site may be retrieved only for use internally within the purchasing Institution and may be downloaded and stored on your hard disk or similar storage device or sent to a printer solely for that purpose.
- 4.3. Notwithstanding clauses 4.1 and 4.2 above, duly authorized users of our site may use all materials therein which they are entitled to access, provided that the user is acting in his/her capacity as Headteacher/adminstrator/co-ordinator within an Institution or where he has been duly authorized to act on behalf of such named person.
- 4.4. The authorized user referred to in clause 4.3 may distribute such materials downloaded from our site to members of the staff of the school employing him, provided that:
- 4.4.1. these materials have been placed on our site for the purpose of distribution and are clearly marked as such, and
- 4.4.2. we are clearly acknowledged as the owner and original source of the materials.
- 4.5. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
- 4.6. Our status (and that of any identified contributors) as the authors of material on our site must always be acknowledged.
- 4.7. You must not use any part of the materials on our site for commercial purposes without obtaining a licence to do so from us or our licensors, which may be granted at our absolute discretion.
- 4.8. If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
- 5. RELIANCE ON INFORMATION POSTED
- 5.1. Commentary and other materials posted on our site are not intended to amount to advice on which reliance should be placed. We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to our site, or by anyone who may be informed of any of its contents. You acknowledge that the information, software, products and servicesincluded in or available through our site mayinclude inaccuracies or typographical errors. We reserve the right to make changes to our and to the information therein.
- 6. OUR SITE CHANGES REGULARLY
- 6.1. We aim to update our site regularly, and may change the content at any time, including these terms. If the need arises, we may suspend access to our site, or close it indefinitely. Any of the material on our site may be out of date at any given time, and we are under no obligation to update such material.
- 7. OUR LIABILITY
- 7.1. The material displayed on our site is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we, other members of our group of companies and third parties connected to us hereby expressly exclude:
- 7.1.1. All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity;
- 7.1.2. Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our site or in connection with the use, inability to use, or results of the use of our site, any websites linked to it and any materials posted on it or available through it, including, without limitation any liability for: loss of income or revenue; loss of business; loss of profits or contracts; loss of anticipated savings; loss of data; loss of goodwill; wasted management or office time; and for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.
- 7.2. You further agree that we shall not be responsible for your transmissions of data, nor for any material or data sent or received through our site. As a result, we will not be liable for any unauthorised access to or loss or alteration of such data and you undertake to make such backup copies or other safeguards as are appropriate.
- 7.3. You further agree that we shall not be responsible for any threatening, defamatory, obscene, offensive or illegal content or conduct of any third party or any infringement of another's rights, including but not limited to intellectual property rights by such third party. You agree that we are not responsible for any content sent via and/orincluded in our site by a third party.
- 7.4. This clause 7 does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.
- 8. INDEMNITY
- 8.1. You agree to indemnify and hold us and our directors, managers, employees and agents harmless from any and all costs (including legal costs), claims, losses, and expenses arising from or related to your breach of all or any of these terms and conditions, (including without limitation any breach of the provisions relating to Data Protection and Privacy set out in data protection and privacy statement.
- 9. UPLOADING MATERIAL TO OUR SITE
- 9.1. Whenever you make use of a feature that allows you to upload material to our site, or to make contact with other users of our site, you must comply with the content standards set out by us in these terms or otherwise on our site from time to time. You warrant that any such contribution does comply with those standards and that you will you use your best endeavours to ensure that such material is true and accurate, and you indemnify us for any breach of that warranty.
- 9.2. In respect of personal data only (as defined in the Data Protection Act 1998) provided to us, we shall use our reasonable endeavours to hold such data securely and free from access other than by persons to whom a username and password have been granted in respect of such data.
- 9.3. We also have the right to disclose your identity to any third party who is claiming that any material posted or uploaded by you to our site constitutes a violation of their intellectual property rights, or of their right to privacy or rights under the Data Protection Act 1998.
- 9.4. We will not be responsible, or liable to any third party, for the content or accuracy of any materials posted by you or any other user of our site.
- 9.5. We have the right to remove any material or posting you make on our site if, in our opinion, such material does not comply with the content standards set out by us in these terms or otherwise on our site from time to time.
- 10. VIRUSES, HACKING AND OTHER OFFENCES
- 10.1. You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack.
- 10.2. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.
- 10.3. We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it, or on any website linked to it.
- 11. LINKING TO OUR SITE
- 11.1. You may link to our home page at http://www.internationalprimarycurriculum.com/ (but not the other domains referred to in these terms as our site), provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
- 11.2. You must not establish a link from any website that is not owned by you.
- 11.3. Our site must not be framed on any other site, nor may you create a link to any part of our site other than the home page. We reserve the right to withdraw linking permission without notice. The website from which you are linking must comply in all respects with the content standards set out in these terms or otherwise on our site from time to time.
- 11.4. You may not make any use of material on our site other than that set out above without our prior written consent.
- 12. LINKS FROM OUR SITE
- 12.1. Our site may contain links to third party website (Links). You acknowledge that we have no means of controlling these Linked sites and that we are not responsible for the contents or availability of any Linked site, including without limitation any link contained in a Linked site, or any changes or updates to a Linked site. We accept no responsibility for any loss or damage that may arise from your use of any Linked site.
- 12.2. The inclusion of any Link does not imply endorsement by us of the Linked site or any association with its operator. We do not guarantee that a Linked site will work appropriately nor that it will not contain computer viruses or other bugs that could harm your Internet-access device.
- 12.3. You are responsible for viewing and abiding by the terms and conditions of use posted at the Linked sites.
- 12.4. Where our site contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.
- 13. JURISDICTION AND APPLICABLE LAW
- 13.1. The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our site although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country. These terms of use are governed by English law.
- 14. TRADE MARKS
- 14.1. The IPC and International Primary Curriculum logos, designs, trademarks and other marks that appear throughout our site belong to us or the relevant third-party trademark owners. You are prohibited from copying and/or using them without prior written consent from the respective trademark owner.
- 15. VARIATIONS
- 15.1. We may revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we made, as they are binding on you. Some of the provisions contained in these terms of use may also be superseded by provisions or notices published elsewhere on our site.

- 17. DEFINITIONS
- 17.1. In these terms Intellectual Property Rights means: all intellectual property rights wherever in the world arising, whether registered or unregistered (and including any application), including copyright, know-how, confidential information, trade secrets, business names and domain names, any and all trade marks, trade names, service marks, trade dress, logos, URLs or identifying slogans of a party to this licence, whether or not registered, patents, petty patents, utility models, design rights, semi-conductor topography rights, database rights and all rights in the nature of unfair competition rights or rights to sue for passing off.
